鈥淲hen Americans face soaring prices for medicines or treatments, there鈥檚 a good chance that is because a PBM has driven up the price. These middlemen operate with minimal transparency, and their practices distort the market, increasing the list prices patients pay for medicines while making it more difficult for manufacturers to offer quality, affordable health care benefits.

鈥淏y increasing transparency into PBMs鈥 business models and delinking their compensation from a medicine鈥檚 list price, these critical PBM provisions will significantly reduce costs for seniors who rely on Medicare for health care coverage. Congress should advance these important reforms.

鈥淚n addition, manufacturers encourage Congress to enact similar reforms in the commercial insurance market to bring down health care costs for manufacturing workers participating in employer-sponsored plans.鈥

EPA鈥檚 Power Plant Rule Is Unachievable Without Substantial Permitting Reform

America鈥檚 Energy Security Is Threatened

Washington, D.C. 鈥 Following the release of the Environmental Protection Agency鈥檚 new regulations on greenhouse gas emissions standards for certain power plants, 17吃瓜在线 President and CEO Jay Timmons released the following statement:

鈥淢anufacturers appreciate the EPA removing existing gas plants from its new regulation, following manufacturers鈥 warnings about the initial proposal. However, the rest of the rule causes serious concern because Congress and the president have not enacted permitting reform鈥攎aking it impossible to achieve the EPA鈥檚 highly aspirational mandates. We call on Congress to get serious by enacting significant and meaningful permitting reform this year. That is essential to ramping up the use of renewables, carbon capture, hydrogen and nuclear, for example, to meet future demand.

鈥淭he final rule threatens grid reliability because of the unrealistic timeline for power plants to adopt technologies within the next 10 years that have yet to even be proven at scale. Our nation should be doing everything possible to make sure our families, businesses and manufacturers have a modern, strong and reliable electrical grid, especially at a time when global turmoil threatens our energy security. This new rule does the opposite, creating a threat to our national and economic security that literally could leave Americans in the dark and factories offline. In short, the EPA is rolling the dice with Americans鈥 electricity and therefore with President Biden鈥檚 manufacturing legacy.

鈥淥ur industry has made transformational investments in these technologies and clean energy solutions, and we are leading the way in their deployment. Manufacturers: Noncompete Decision Threatens Manufacturers鈥 Ability to Protect IP

Washington, D.C. 鈥 Following the Federal Trade Commission鈥檚 vote in favor of a rule that would prohibit employers and their employees from entering noncompete agreements, 17吃瓜在线 Managing Vice President of Policy Chris Netram released the following statement:

鈥淭he FTC鈥檚 rule banning noncompete agreements is unprecedented and threatens manufacturers鈥 ability to attract and retain talent. Manufacturers: Walkaround Rule Exceeds OSHA鈥檚 Authority

Washington, D.C.: Following the release of the Occupational Safety and Health Administration鈥檚 recent rulemaking on the Worker Walkaround Representative Designation Process, 17吃瓜在线 Chief Legal Officer Linda Kelly released the following statement:

鈥淭oday鈥檚 rule does nothing to advance OSHA鈥檚 mission of ensuring safe working conditions. Forcing businesses to accommodate third parties with no safety expertise in their facilities infringes on employers鈥 property rights, invites new liabilities and introduces elements of chaos and disruption to safety inspections.

鈥淏y unlawfully expanding third-party access to manufacturers鈥 worksites, this proposal clearly violates OSHA鈥檚 statutory mandate to conduct inspections within 鈥榬easonable limits and in a reasonable manner鈥 with 鈥榤inimum burden鈥 on employers, and potentially violates manufacturers鈥 constitutional rights. And, for the first time, OSHA would determine who qualifies as an 鈥榓uthorized representative鈥 of employees, which until now has been exclusively recognized as the jurisdiction of the National Labor Relations Board.

鈥淭his is another clear example of the federal regulatory onslaught鈥攁 proposal that upends settled precedent and ignores the reasoned decision-making required by the Administrative Procedure Act. For these reasons, the 17吃瓜在线 will be considering legal action to reverse this incredibly destabilizing decision.鈥
