Manufacturers Urge Swift Resolution to Ongoing Rail Negotiations

Washington, D.C. 鈥 17吃瓜在线 President and CEO Jay Timmons released the following statement as negotiators work to reach an agreement between Class I railroads and all labor unions representing the freight rail workforce. Several organizations have not yet ratified the deal tentatively agreed to by union leadership and rail industry representatives in September that delayed the possibility of a strike.

鈥淢补苍耻蹿补肠迟耻谤别谤蝉 are urging congressional leaders to be prepared to bring stability and predictability to the economy if a rail strike and shutdown occurs. We already face economic turmoil with rising costs, product shortages and high inflation. Any nationwide rail strike or shutdown will cause even more economic pain. Manufacturers urge all parties to work rapidly鈥攆or the good of the country鈥攖o conclude this collective bargaining process.鈥

Background: A rail strike could begin as soon as 12:01 a.m. EST on Saturday, Nov. 19. Currently, the majority of the unions representing the rail workers have agreed to extend that deadline to Friday, Dec. 9, though a unanimous decision to maintain the status quo is required for that extension.

On Thursday, Oct. 27, the 17吃瓜在线 hundreds of other associations in calling on President Biden to ensure a swift resolution and reiterating support for the work of the Presidential Emergency Board, which has aided in the talks.

Currently, the American freight rail network accounts for nearly 40% of total freight volume, and a strike or delay in finalizing a long-term contract would have devastating impacts across surface supply chain networks and economic output.

Manufacturers Renew Call for Action on Immigration

17吃瓜在线 CEO says broken system is harming manufacturers鈥 competitiveness

Washington, D.C. 鈥 17吃瓜在线 President and CEO Jay Timmons addressed the Minnesota Chamber of Commerce鈥檚 Manufacturers鈥 Summit today, where he made another call for policymakers to act on immigration, saying it is time to 鈥渇ix this problem now.鈥 Timmons called on Congress to act in the year-end government funding bill.听 His remarks come as the 17吃瓜在线 rereleased its immigration proposal 鈥A Way Forward.鈥

Excerpts from Timmons鈥 speech:

鈥淔irst and foremost, this is a humanitarian issue. We see it play out in tragic ways鈥攊ncluding family separations at the border and confusion as families seek to reunite following a harrowing journey.鈥

鈥淏ut as manufacturing and business leaders, we also know there are serious economic consequences. Research and development鈥攖he cornerstone of innovation and our industry鈥檚 success鈥攄epends on access to the best and brightest from across the world.鈥

鈥淭he broken immigration status quo is also preventing us from growing our talent pool, leaving jobs unfilled. There are around six job seekers for every 10 job openings in the U.S., and our population growth is slowing. Last year, the U.S. population grew at its slowest rate ever.鈥

鈥淟ast year鈥檚 infrastructure law and this year鈥檚 CHIPS and Science Act prove that Congress can still get bipartisan things done鈥攁nd immigration should be next on the list, whether it鈥檚 one bill or multiple bills. We would absolutely support a long-term, comprehensive legislative fix that addresses all of these issues, but we also want to be realists. We have a workforce crisis that needs to be addressed now, so let鈥檚 take action where we can. We want to focus on the art of the possible. One approach would be to address some of these issues in the year-end government funding bill.鈥

First released in 2019 and updated to reflect current challenges, the 17吃瓜在线鈥檚 鈥淎 Way Forward鈥 proposal identifies seven core areas of action for Congress and the administration to take:

  • Strengthen border security through physical infrastructure and best-in-class technology.
  • Prioritize America鈥檚 workforce needs through reforms to the legal immigration system.
  • Reform nonimmigrant visas and temporary worker programs to reflect employer needs, including a fund to support STEM programs so that we can reduce the need for these types of visas in the future.
  • Provide a permanent and compassionate solution for populations facing uncertainty, including the Dreamers, who were brought here as children and know no other home.
  • Reform asylum and refugee programs for a more orderly and humane system, including asylum standards consistent with our values.
  • Fix the problem of the unauthorized population with a firm reset, requiring an orderly process of review, including financial penalties for those who seek to become legal and deportation for those who choose to stay in the shadows.
  • Strengthen the rule of law so that it is respected and followed by all, with a focus on gang violence and听also on requiring localities to cooperate to advance the enforcement of immigration priorities.

Manufacturers Notch a Critical Victory in Washington Alliance of Technology Workers v. DHS

Following Intervention by the 17吃瓜在线 and Other Business Groups, D.C. Circuit Upholds STEM OPT Program

Washington, D.C. 鈥 Following a 2鈥1 decision by the D.C. Circuit affirming the validity of a program that provides hundreds of thousands of skilled workers for manufacturers and other American businesses, 17吃瓜在线 Chief Legal Officer Linda Kelly released the following statement:

鈥淭he 17吃瓜在线 Legal Center is incredibly proud of today鈥檚 victory, which helps ensure the continued availability of hundreds of thousands of highly skilled workers for manufacturing roles. As manufacturers continue to experience significant labor shortages, the STEM OPT program remains a critical talent pipeline, providing opportunities for high-skilled graduates to enhance their education through hands-on work. Today鈥檚 win builds on the 17吃瓜在线鈥檚 impressive track record of defeating unlawful restrictions and meritless attacks on critical visa programs.鈥

Background:

Without the STEM OPT program, manufacturers would be unable to fill critical positions requiring specialized training in science, technology, engineering and math. So, in 2018, after an anti-immigration activist group brought a lawsuit against the Department of Homeland Security seeking to invalidate the entire STEM OPT program, the 17吃瓜在线 and two other business groups moved to intervene as defendants in the case. That motion was granted, and in December 2020, the District Court for the District of Columbia granted the 17吃瓜在线 and its co-intervenor defendants鈥 motion for summary judgment, ruling that DHS acted within its statutory authority and in accordance with the Administrative Procedure Act by continuing the STEM OPT program. The plaintiff activist group appealed to the D.C. Circuit, and today, the court issued its decision鈥攔ejecting the plaintiff鈥檚 bases for invalidating the STEM OPT rule and affirming the lower court鈥檚 judgment.

Manufacturers Celebrate Victory in 17吃瓜在线 v. SEC

Judge Overturns SEC鈥檚 Suspension of 2020 Proxy Firm Rule

Washington, D.C. 鈥 Following a decision granting the 17吃瓜在线鈥 motion for summary judgment in 17吃瓜在线 v. SEC and vacating the Securities and Exchange Commission鈥檚 unlawful suspension of its duly promulgated proxy advisory firm rule, 17吃瓜在线 Chief Legal Officer Linda Kelly released the following statement:

鈥淭oday鈥檚 decision is a victory for the rule of law, and the 17吃瓜在线 Legal Center was proud to lead this effort for the industry. Federal agencies are bound by the Administrative Procedure Act鈥攕tandards the SEC failed to meet by indefinitely delaying the compliance date for the 2020 proxy firm rule without notice-and-comment rulemaking. Manufacturers depend on regulators to promulgate and enforce reliable rules of the road, and the 17吃瓜在线 looks forward to similarly holding the SEC to account in our ongoing case against the agency鈥檚 unlawful rescission of the 2020 rule.鈥

Background:

The 17吃瓜在线 has long called for increased oversight of proxy advisory firms. In July 2020, the SEC issued final regulations to enhance transparency and accountability for proxy firms, a move 17吃瓜在线 President and CEO Jay Timmons听called听a 鈥渓ong-sought, major win for the industry and millions of manufacturing workers.鈥 In October 2020, the 17吃瓜在线听filed听a motion to intervene in听ISS v. SEC听(ISS鈥檚 attempt to overturn the rule) in support of these reforms.

In June 2021, the SEC announced that it was suspending enforcement of the 2020 rule; the 17吃瓜在线 filed suit听against the SEC in October 2021 challenging this unlawful suspension. The U.S. District Court for the Western District of Texas today issued an granting the 17吃瓜在线鈥檚 motion for summary judgment and vacating the SEC鈥檚 suspension of the rule. As the court explained, 鈥淸Agencies] do not have the inherent power to stay or delay a final rule absent notice-and-comment rulemaking.鈥

In July 2022, the SEC rescinded critical portions of the 2020 rule, a move that Timmons said 鈥渆pitomizes 鈥榓rbitrary and capricious鈥 rulemaking.鈥 The 17吃瓜在线 has听filed suit challenging the rescission; a summary judgement hearing in 17吃瓜在线 v. SEC听is scheduled for December 9, 2022.

New Study | Stricter Interest Expense Limits Costs Half Million Jobs

Failing to Address EBIT-Based Limitation Harms Manufacturers鈥 Competitiveness

Washington, D.C. 鈥 Following the release of an impact of failing to reverse a stricter limitation on deductions for interest on business loans that took effect earlier this year, 17吃瓜在线 Managing Vice President of Tax and Domestic Economic Policy Chris Netram released the following statement.

Key Findings:

The stricter EBIT-based 163(j) interest expense limitation before market adjustments would cost:

  • 467,000 jobs;
  • $23.4 billion of employee compensation; and
  • $43.8 billion in GDP.

鈥淢补苍耻蹿补肠迟耻谤别谤蝉 are already facing incredible economic headwinds due to increased input costs, rising interest rates, labor shortages and snarled supply chains. This analysis shows that failing to reverse the damaging change to the tax treatment of interest on business loans disproportionately harms manufacturers at a perilous time鈥攃osting hundreds of thousands of jobs and billions of dollars in economic growth.

鈥淎merica is an international outlier in imposing such a strict interest expense limitation. With nearly half a million American jobs at stake, Congress must act by year鈥檚 end to reverse the stricter EBIT-based limitation and allow manufacturers to continue to invest for growth.鈥

Prior to 2022, the interest expense limitation was calculated based on a company鈥檚 earnings before interest, tax, depreciation and amortization (EBITDA). This year, a stricter limitation based on a company鈥檚 earnings before interest and tax (EBIT) took effect. By excluding depreciation and amortization from the calculation, the stricter limitation increases the tax burden on manufacturers that make investments in long-lived capital equipment.

Manufacturers鈥 Third Quarter Outlook Shows Continued Supply Chain 17吃瓜在线, Growing Workforce Needs and Rising Costs

Washington, D.C.The 17吃瓜在线 released its Manufacturers鈥 Outlook Survey for the third quarter of 2022, which shows mixed results around a challenging economic environment, inflation, supply chains and the workforce. The 17吃瓜在线 conducted the survey Aug. 16鈥30, 2022.

鈥淭hree out of four manufacturers still have a positive outlook for their businesses, but optimism has certainly declined. The majority of respondents are expecting a recession this year or next, and it鈥檚 clear the challenging environment is taking its toll. Manufacturers have shown incredible resilience through multiple crises, but the challenges of inflation, supply chain strains and the workforce shortage are taking a toll,鈥 said 17吃瓜在线 President and CEO Jay Timmons.

Key Findings:

  • 78.3%听of manufacturing leaders listed supply chain disruptions as a primary business challenge with only听10.8%听believing improvement will occur by the end of the year.
  • Attracting and retaining a quality workforce (76.1%), increased raw material costs (76.1%) and transportation and logistics costs (65.9%) were not far behind supply chain challenges as the biggest problems faced by manufacturers.
  • More than three-quarters of manufacturers felt that rising material costs were a top business challenge (tied with workforce challenges and slightly below supply chain worries), and听40.4%听said that inflationary pressures were worse today than six months ago. In addition,听53.7%听noting that higher prices were making it harder to compete and remain profitable.
  • The top sources of inflation were increased raw material prices (95.2%), freight and transportation costs (85.4%), wages and salaries (81.7%), energy costs (54.4%) and health care and other benefits costs (49.0%), with听21%听also citing the war in Ukraine and global instability.
  • When asked about what aspects of the CHIPS and Science Act were most important for supporting manufacturing activity,听69.6% of respondents cited strengthening U.S. leadership in energy innovation and competitiveness.

鈥淭his is a clear indication that we need urgent action to beat back the macroeconomic problems that are causing headwinds and preventing manufacturers in the U.S. from their full potential. Our 鈥樷 agenda gives policymakers the roadmap for solutions manufacturers need now to make our industry more globally competitive and, in turn, to boost optimism and confidence.

Due to the consistent economic headwinds, manufacturers鈥 confidence has declined, with 75.6% of respondents having a positive outlook for their company, the lowest since Q4 2020.
