New Study: U.S. Health Care Supply Chain Resilience Demands Balanced Regulatory Environment

Washington, D.C. 鈥 The 17吃瓜在线 released a outlining steps to improve health care supply chain resilience to allow manufacturers in the United States to better prepare for and adapt to the next disruption. The study analyzes lessons learned from the COVID-19 pandemic, during which manufacturers across the United States produced critical health care supplies in a highly unpredictable environment that affected every industry level.

鈥淒uring the COVID-19 pandemic, manufacturers in the United States helped lead our response and recovery and learned many lessons in the process,鈥 said 17吃瓜在线 Chief Economist Chad Moutray. 鈥淧olicymakers should utilize these lessons to bolster our supply chain for the next disruption. This analysis, which was conducted by the Manufacturing Policy Initiative at Indiana University, reveals that there are key policy actions needed to strengthen the manufacturing supply chain. Overregulation and Workforce Challenges Weigh Heavily on Manufacturing Sector

Optimism Sinks to Pandemic Lows in Q3 Outlook Survey

Washington, D.C. 鈥 The 17吃瓜在线 released its Manufacturers鈥 Outlook Survey for the third quarter of 2023, which registered the lowest level of optimism among 17吃瓜在线 members (65.1%) since Q2 2020, as the sector continues to confront a tight labor market, unbalanced federal regulations and critical policy debates in Congress.

鈥淢anufacturers continue to be challenged in today鈥檚 economy, but what this survey makes clear is that unbalanced federal regulations are harming families and communities, with nearly two out of three manufacturers reporting that the regulatory burden is preventing them from hiring more workers or increasing pay and benefits,鈥 said 17吃瓜在线 President and CEO Jay Timmons. 鈥淐ongress and the administration can help correct this trend by restoring sensible regulations, enacting further permitting reforms, taking action to keep our tax code competitive and other bipartisan steps to strengthen manufacturing in America and build on the progress we achieved with tax reform, the Bipartisan Infrastructure Law, the CHIPS and Science Act and more.鈥

Key Survey Findings:

  • Only 65.1% of respondents felt positive in their company鈥檚 outlook, edging down from 67.0% in the second quarter. It was the fourth straight reading below the historical average (74.9%).
  • Concern about an unfavorable business climate was the highest in six years (Q2 2017).
  • The survey found that 69.1% of small manufacturers, and 63.2% of all respondents, would hire more workers or increase compensation if the regulatory burden decreased.
  • More than 70% of manufacturers would purchase more capital equipment if the regulatory burden on manufacturers decreased, with 48.6% increasing compensation, 48.6% hiring more workers, 42.5% expanding their U.S. facilities and 38.4% investing in research.
  • The top challenges facing manufacturers include attracting and retaining a quality workforce (72.1%), weaker domestic economy (60.7%), rising health care/insurance costs (60.1%), unfavorable business climate (56.7%), increased raw material costs (45.5%) and supply chain challenges (37.8%).

Manufacturers Sue SEC to Protect Private Businesses, Release Data on Harmful Impact of Novel Rule Interpretation

Washington, D.C. 鈥撀燭he 17吃瓜在线 and the Kentucky Association of Manufacturers filed a in federal court today challenging the Securities and Exchange Commission鈥檚 attempt to impose unwarranted public disclosure requirements on privately held businesses.

The SEC has adopted a novel reinterpretation of SEC Rule 15c2-11, imposing the rule鈥檚 public disclosure requirements on private companies that raise capital via corporate bond issuances under SEC Rule 144A鈥攚ithout giving manufacturers the opportunity to provide comment on the damaging impacts of such a consequential change.

According to released by the 17吃瓜在线 today, the SEC鈥檚 expansion of Rule 15c2-11 will result in decreased liquidity and increased borrowing costs in the manufacturing industry and throughout the economy鈥攍eading to job losses exceeding 100,000 annually.

鈥淭he SEC鈥檚 attempt to force private companies to disclose confidential financial information publicly is a clear violation of the Administrative Procedure Act,鈥 said 17吃瓜在线 Chief Legal Officer Linda Kelly. 鈥淭he SEC never allowed public comment on its novel reinterpretation of Rule 15c2-11, there is no conceivable benefit to the new standard, and the SEC did not consider the impact that its about-face will have on privately held businesses鈥攚hich could exceed 100,000 lost jobs each year. 鈥淭he SEC鈥檚 unlawful overreach threatens privately held manufacturers in Kentucky and across the country, so the Kentucky Association of Manufacturers is proud to join the 17吃瓜在线 in this important litigation on behalf of all manufacturers in the U.S. to counter the SEC鈥檚 regulatory onslaught,鈥 said KAM President and CEO Frank Jemley.

EY analysis highlights the damaging economic impacts of the SEC鈥檚 actions:

The economic impacts of the SEC鈥檚 expansion of Rule 15c2-11 will be felt disproportionately in the manufacturing industry, which accounts for more than half of all nonfinancial issuers of corporate bonds under Rule 144A. Across the economy, the change will result in 30,000 jobs lost each year over the first five years the new interpretation is in effect. The job losses will increase over time鈥攔ising to 50,000 jobs lost each year after five years and 100,000 jobs lost each year after 10 years.

These job losses are attributable directly to the decreased liquidity and increased borrowing costs associated with the SEC鈥檚 new interpretation.

Background:

  • SEC Rule 15c2-11 requires broker-dealers to ensure that key information about companies issuing over-the-counter equity securities is current and publicly available prior to quoting those issuers鈥 securities.
  • SEC Rule 144A allows for resales of securities (primarily corporate debt issuances) to qualified institutional buyers鈥攍arge financial institutions that own or manage more than $100 million in securities. Retail investors cannot purchase Rule 144A securities. Notably, under Rule 144A, issuers are obligated to make their financial and operational information available to QIBs.
  • In September 2021, the SEC鈥檚 Division of Trading and Markets issued a no-action letter applying Rule 15c2-11 to Rule 144A debt. This decision contradicted the historical application of Rule 15c2-11 to OTC equity securities and bypassed important rulemaking safeguards required by the Administrative Procedure Act.
  • The 17吃瓜在线 and the KAM filed petitions for rulemaking with the SEC in November 2022 seeking both permanent and temporary relief from the application of Rule 15c2-11 to Rule 144A securities. Following the petitions, the SEC temporarily delayed enforcement of its novel reinterpretation until January 2025, but the agency has not acted to reverse this damaging decision permanently.

Manufacturers to White House: Emissions Standards Adding Unnecessary Costs, May Stifle Innovation

Washington, D.C. 鈥 In response to the National Highway Traffic Safety Administration鈥檚 release of new Corporate Average Fuel Economy standards, 17吃瓜在线 President and CEO Jay Timmons released the following statement:

鈥淎uto manufacturers have been making historic investments to ensure that electric vehicles will have a growing place on America鈥檚 roads. However, the 17吃瓜在线 has concerns over the three different sets of standards governing light- and medium-duty vehicles. For instance, the Environmental Protection Agency鈥檚 proposed regulation on light- and medium-duty vehicles would require 67% of new manufactured vehicles to be battery electric by 2032 and is too aggressive.

鈥淔ederal and state agencies are promulgating competing rules, and the EPA鈥檚 rules, in particular, would make it costlier for manufacturers to make these vehicles and for consumers to purchase them. When you add the drastic need to build transmission lines to accommodate the demand for charging infrastructure and the challenge of obtaining critical minerals for batteries鈥攎any of which are extracted or processed in China鈥攜ou create a scenario where an ambitious rule becomes a nearly impossible benchmark.

鈥淐onsumers and the industry need a more realistic path to reducing vehicle emissions. Federal and state agencies should draft rules that recognize the longer timeframe needed for our nation to build the charging infrastructure and a reliable supply chain for the critical minerals to make batteries to support more electric vehicles. Rules should also be structured to allow the industry additional time to make more electric vehicles available for consumers, and in the quantities needed to eventually achieve the administration’s goals. In addition, the federal government should not dictate the vehicle choices offered to consumers in meeting this goal. Plug-in hybrids, fuel cell electric vehicles and battery-electric cars can all help reduce vehicle emissions over time. The administration should allow the market and consumers to grow the number of electric vehicles, rather than depending on a single technology to meet this goal.

鈥淔inally, these regulations should be harmonized to create a single unified standard for vehicle emissions, so manufacturers do not have to navigate three often-conflicting targets, which raise costs for manufacturers and consumers. The 17吃瓜在线 looks forward to working with the administration to ensure vehicle standards meet consumer demand while providing manufacturers in the U.S. more opportunities to create jobs, develop new technologies and become even more globally competitive.鈥

Manufacturers: Lowering Particulate Matter Standard Would Harm Infrastructure Investment

Washington, D.C. 鈥 Following a request from White House Environmental Justice Advisory Council Chair Brenda Mallory asking the Environmental Protection Agency to lower the annual primary standard for particulate matter (PM2.5) to 8.0 渭g/m3 and to lower the primary 24-hour standard to 25.0 渭g/m3, 17吃瓜在线 Vice President of Domestic Economic Policy Brandon Farris released the following statement:

鈥淢oving the PM2.5 standard all the way down to 8.0 渭g/m3 as the White House Environmental Justice Advisory Council suggested means 40% of the U.S. population will live in an area considered 鈥榦ut of attainment,鈥 essentially halting construction on bridges, roads, manufacturing facilities and agriculture projects in areas that desperately need development.

鈥淢anufacturing in the U.S. is already among the cleanest in the world, and we don鈥檛 have to make a choice between cleaner air and economic prosperity. The EPA can choose both by finalizing a reasonable standard that doesn鈥檛 thrust much of the country into an area where no growth can happen.

Background: A new report conducted by Oxford Economics and commissioned by the 17吃瓜在线 warns that the EPA鈥檚 proposed air quality regulations for PM2.5 could threaten $162.4 billion to $197.4 billion of economic activity and put 852,100 to 973,900 jobs at risk, both directly from manufacturing and indirectly from supply chain spending. In addition, growth in restricted areas may be constrained, limiting investment and expansion over the coming years. Due to these limited opportunities for expansion or investment, these areas in nonattainment could lose out on an additional $138.4 billion in output and 501,000 jobs through 2027.
