The main way to do it, she said, is by restoring three key tax policies: immediate expensing for domestic R&D, enhanced interest deductibility and full expensing.

What鈥檚 going on: Thanks to the 2017 Tax Cuts and Jobs Act, Silver鈥檚 family-owned, North Carolina鈥揵ased precision machining company and many other manufacturers were able to grow their companies, invest in workers and give back to their communities, Silver said in testimony during the 鈥淎merican Made: Growing U.S. Manufacturing Through the Tax Code鈥 hearing.

As lawmakers consider proposals to scale back the de minimis treatment of low-value goods entering the U.S., the 17吃瓜在线 and several of its partners are reminding stakeholders of the importance of having a streamlined, tariff-free customs entry process for such imports.

  • These shipments are still subject to all U.S. laws and information requirements that enable enforcement at the border.

Last week, a group consisting of labor unions, select business associations and other stakeholders formed a coalition against certain de minimis imports, according to .听

A critical provision: The 17吃瓜在线 and six allied groups pushed back, urging the White House to maintain the so-called 鈥渄e minimis鈥 import entry type, which permits goods valued at less than $800 to enter the U.S. in a streamlined manner and tax-free.

  • 鈥淒e minimis has benefitted thousands of American small businesses across all sectors,鈥 said the groups. 鈥淔or example, de minimis allows businesses to obtain inputs for domestically manufactured products into the United States more efficiently and with fewer unnecessary administrative requirements.鈥
  • 鈥淚t has also made purchasing goods online more affordable and accessible for consumers at a time of inflation and supply chain challenges. … The average value of a de minimis package is roughly $50. If de minimis were to be eliminated or significantly degraded 鈥 a $50 delivery could become a more than $100 delivery.鈥

Combating disinformation: Proponents of eliminating or significantly degrading de minimis cite several concerns with the entry type that are unfounded, the 17吃瓜在线 and its allies said.

  • 鈥淭here is no evidence that illegal products are more prevalent in de minimis shipments,鈥 they went on, citing a CBP executive who the false claim that de minimis shipments aren鈥檛 screened.
  • When it comes to fentanyl, 鈥淸a]s government enforcement statistics make clear, the overwhelming majority of fentanyl enters the United States in large shipments from Mexico 鈥 smuggled in passenger vehicles, by pedestrians, and concealed in truck shipments. De minimis packages, on the other hand, arrive in the United States overwhelmingly by air transportation throughout the country.鈥
  • Finally, eliminating the de minimis entry type would strain border control. 鈥淸D]egrading de minimis and routing one billion shipments into more resource intensive processing streams would require tens of thousands of CBP personnel to process information that is not related to enforcement and collect duty, rather than spending that time on activities that would actually interdict illicit items.鈥

Other solutions: The letter urges the administration to consider 鈥減ractical, innovative ways to improve de minimis without increasing costs for consumers and small businesses.鈥

  • Customs and Border Protection should use the authority it already has to build on existing enforcement of U.S. trade laws at the border by separating the vast universe of compliant shipments from illicit packages.

鈥淭here鈥檚 a competitive advantage if our manufacturers are paying less for a key input than others,鈥 Turk said. 鈥淭here鈥檚 a benefit and a difference between the price right now that we pay in the U.S. versus others internationally.鈥

Meeting matters: The U.S. is the world鈥檚 top exporter of LNG, an affordable, plentiful energy source that鈥檚 in growing demand and is much cleaner than traditional forms of coal-powered energy鈥攅specially in Europe, where LNG has been critical in keeping allied countries from seeking Russian energy sources. SEC Finalizes Scaled-Back Climate Rule

The Securities and Exchange Commission has approved new climate disclosure requirements that have been in the works for the past two years. Changes made to the rule represent progress for manufacturers鈥攖hough the industry will still face new cost burdens, the 17吃瓜在线 said Wednesday night.

What鈥檚 going on: The SEC voted Wednesday in favor of requiring public companies to disclose greenhouse gas emissions and other climate-related information. Thanks in part to ongoing 17吃瓜在线 advocacy鈥攚hich (subscription) covered this week鈥攖he agency dropped its onerous, unworkable Scope 3 emissions mandate.

  • That provision would have forced public companies to divulge information about emissions coming from anywhere in their supply chains鈥攊ncluding from small and family-owned businesses.

The 17吃瓜在线 and seven association partners have filed suit against the Environmental Protection Agency to challenge the office鈥檚 overly stringent, recently finalized rule on particulate matter, or PM2.5, the 17吃瓜在线 said Wednesday.

What鈥檚 going on: The eight groups filed suit in the D.C. Circuit to push back on the EPA鈥檚 National Ambient Air Quality Standards rule, which last month it lowered from 12 micrograms per cubic meter of air to 9, a 25% reduction and a stifling burden on manufacturers, the 17吃瓜在线 said.

  • 鈥淚n pursuing this discretionary reconsideration rule, the EPA should have considered the tremendous costs and burdens of a lower PM2.5 standard,鈥 said 17吃瓜在线 Chief Legal Officer Linda Kelly. 鈥淚nstead, by plowing ahead with a new standard, the agency not only departs significantly from the traditional NAAQS process, but also gravely undermines the Biden administration鈥檚 manufacturing agenda鈥攕tifling manufacturing investment, infrastructure development and job creation in communities across the country.鈥

Manufacturers Challenge EPA鈥檚 Untenable Air Standard in Court

The 17吃瓜在线 Legal Center has sued to block the rule

Washington, D.C. Today, the 17吃瓜在线 joined a coalition of other major business trade associations to file suit in the D.C. Circuit to challenge the Environmental Protection Agency鈥檚 misguided final rule lowering the National Ambient Air Quality Standards for fine particulate matter (PM2.5) to 9 micrograms per cubic meter.

The EPA finalized this provision鈥攁 25% reduction from the current standard effective on a truncated timeline of 60 days鈥攐utside of the Clean Air Act鈥檚 normal five-year review cycle, becoming the first administration to redo a promulgated NAAQS.

鈥淚n pursuing this discretionary reconsideration rule, the EPA should have considered the tremendous costs and burdens of a lower PM2.5 standard,鈥 said 17吃瓜在线 Chief Legal Officer Linda Kelly. 鈥淚nstead, by plowing ahead with a new standard that is vastly more restrictive than any other national standard, including that set by the EU, the agency not only departs significantly from the traditional NAAQS process, but also gravely undermines the Biden administration鈥檚 manufacturing agenda鈥攕tifling manufacturing investment, infrastructure development and job creation in communities across the country. Background:

  • The Clean Air Act requires the EPA to review the NAAQS every five years to determine whether the PM2.5 standard should be retained or revised. The EPA鈥檚 revised standard was done in an out-of-cycle reconsideration.
  • In December 2020, following a complete review of the PM NAAQS, the EPA decided to retain the PM2.5 standard of 12 micrograms per cubic meter. But in June 2021, the agency announced it would reconsider that decision.
  • The 17吃瓜在线 submitted urging the EPA to maintain the existing standard. The EPA recently reported that PM2.5 concentrations have declined by 42% since 2000, driven by major emissions reductions from both mobile sources and the power sector.
  • Notably, the EU standard is currently 25, and a proposal there would be to reach 10 by 2030. The UK has a target of 10 by 2040.
  • The EPA itself says that some 70% of particulate matter comes from nonmanufacturing sources, such as wildfires (29%), agriculture and prescribed fires (15%), crop and livestock dust (12%), unpaved road dust (10%), paved road dust (3%) and 鈥渄ust鈥 (2%).
